CONDITIONS OF SALE
The online sales system, which requires an active intervention by the Customer, was created in full compliance with the legislation on distance selling and in particular with Articles 49 et seq. of the Consumer Code (Legislative Decree No. 206 of 6 September 2005 and subsequent amendments and additions). The use of the distance selling process described in these general conditions of sale is reserved exclusively for consumers as defined by art. 3 of Legislative Decree 206 of 6 September 2005 (hereinafter referred to as the "Customer" or "Customers" for the sake of brevity).
OBLIGATIONS OF THE CUSTOMER
The Customer is required, before submitting his purchase order, to carefully read these general conditions of sale. The forwarding of the purchase order implies their full knowledge and acceptance.
1. Order of the product and conclusion of the contract
The order can be placed through the website www.memomorableshirts.com by selecting any image of the product presented in it and in any case following the steps and instructions specified on the site itself. To make any changes and / or corrections to the order, the Customer must follow the relative instructions contained on the Site.
The order will be sent by clicking the "Buy Now" button and will be filed in the order custody database for the period of time required by current legislation.
The order will therefore be considered a contractual purchase proposal. Upon receipt of the order, Memorable Shirts LLP will send the Customer an email containing the order number and information about the products ordered, the price detail of each product, the shipping address as well as the payment methods and the indicative delivery times. . This email does not constitute acceptance of the Customer's purchase proposal, but only constitutes confirmation of having received the order. Upon receipt of the Customer's order, Magliette Memorabili will check the availability of the products ordered as well as the correctness of the information provided by the Customer.
The sales contract with Memorable Shirts LLP will only end with the sending of a separate email accepting the purchase proposal and / or confirming the shipment of the ordered products.
The Customer's order may be refused in the event of an error in the information provided by the customer, in the event that the available products have run out, in the event that insufficient guarantees of solvency are found, if the order does not correspond to normal consumption needs (requirement which is applied both in relation to the number of products purchased within a single order and in the case of a plurality of orders relating to the same product, even if each order includes a quantity of products corresponding to normal consumption needs) , or for reasons of force majeure.
If the order cannot be accepted, Memorable Shirts LLP will communicate within 10 days. following receipt of the order, any impossibility of processing the order itself, followed by the immediate release of the amount reserved for payment.
2. Product price
The price of the product published on the site refers to the single item, expressed in Euro and inclusive of VAT. Memorable Shirts LLP will pay all taxes, duties, charges and / or shipping costs.
3. Terms of payment
We accept PayPal and credit or debit cards belonging to the Visa, MasterCard, Discover, AMEX, Diners, CUP, JCB and Maestro circuits.
The total amount of the order is committed to the Customer's credit card or PayPal account at the time the order is sent to Memorable Shirts LLP (when the Customer selects "Buy now"), with simultaneous acceptance by Memorable Shirts LLP, pursuant to art. 4, and activation of the preparation of products for shipment. In order to prevent fraud on the Internet, the payment made through the website www.memorableshirts.com is managed online by the bank that manages the Customer's credit card, through the tools offered by Wix Payments and PayPal. Wix Payments, PayPal and their respective subsidiaries are responsible for the storage and automatic processing in a secure environment of the information relating to each order, including the details of the credit card used.
For payment purposes, the Customer must:
- in case of payment by credit card, confirm the data of the credit card holder used for the purchase through the website www.memorableshirts.com; then communicate on the site the 16-digit number and the expiry date, as well as the relative security code.
- in case of payment through a PayPal account, enter the access details in the appropriate space on the PayPal page to which it will be sent back automatically, and then complete the payment in the manner indicated by the service provider.
The conclusion of the order procedure will be considered effectively occurred, following the completion of the payment operations, once the Customer is redirected to the page of the website www.memorableshirts.com confirming the acceptance of the order.
4. Delivery
The delivery of the products is carried out exclusively on Italian territory, to the address indicated by the Customer, only after the regular payment of the order forwarded to Memorable Shirts LLP. The Customer does not have the possibility to request the delivery of the products to post office boxes and / or similar. In compliance with the provision contained in art. 61 of the Consumer Code, Memorable Shirts LLP will deliver the products no later than 30 days from the day on which the Customer has placed the order. In the event of unavailability of the recipient, or of another person authorized to receive the shipment at the time of the delivery attempt, the express courier will make a further delivery attempt the next day, in the event that the second attempt is also unsuccessful. , the express courier will issue a paper notice containing their contact details and the collection point from which it will be possible to collect the products. If the Customer does not collect the products from the collection point within 10 days, the ordered products will be returned to the warehouse. Customer Service will contact the Customer to agree whether to proceed with a new shipment of the ordered products or whether to refund the relative payment.
5. Shipping Costs
With Memorable Shirts, shipping is free for purchases over € 39.90.
For orders of lower amounts, a fee will be calculated based on the product and destination.
6. Right of Withdrawal
The Customer can exercise the right of withdrawal provided for in Article 52 of the Consumer Code within 14 (fourteen) calendar days from the day on which the Customer or a third party, other than the carrier and designated by the Customer, acquires physical possession of the goods. .
7. Returns
In case of exercise of the right of withdrawal, the Customer can return the products by contacting Customer Service exclusively by email at Magliettememorabili@gmail.com asking to use the Memorable Shirts LLP return procedure.
The customer is responsible for all return costs, whatever the reason.
The products must be returned within 14 days of exercising the right of withdrawal, to the address indicated on the package received. If you have any questions or concerns about the return address, please contact customer service.
7.1 Conditions of integrity for the return
According to the provisions of Article 57 of the Consumer Code, the consumer is liable if the products returned by the Customer are damaged, incomplete, deteriorated and / or used in a manner that does not comply with normal diligence. An asset is considered to be used beyond normal diligence in the case of use beyond what is necessary to establish its nature, characteristics and functioning (e.g. in case of removal of the labels, if the garment has been worn and not just tried on ).
You can return an item purchased on www.memorableshirts.com only in the same condition in which it was received. The Customer must therefore ensure that:
- the item has not been used or has suffered damage during the test;
- the item has not been soiled or has undergone washing;
- the item retains all the pendants, the labels, the guarantee seal placed on the garment at the time of the quality control and the original finishes;
- the article has not undergone any changes of any kind.
In case of return of the damaged, incomplete, deteriorated and / or in conditions of use that do not comply with normal diligence, without prejudice to the right of withdrawal, the Customer will be charged the sum corresponding to the decrease in value of the asset. In such cases, Diffusione Tessile will promptly notify the Customer of the damages and non-conformities found upon receipt of the items. The sum charged to the Customer, which in any case cannot be higher than the price paid for the purchase of the item, will be deducted from the refund due to the Customer.

7.2 Items not ordered, damaged or different from the order
We wish to inform our Customers that Memorable Shirts LLP subjects its garments and the materials with which they are packaged to strict quality controls, guaranteeing that they are marketed in perfect condition. In addition, for greater protection of those who make remote purchases, every single item sent by www.memorableshirts.com is checked before shipping. Memorable T-Shirts LLP adopts the best photographic standards, so that on the site, the color rendering of the garments is as close to how it appears live. Possible variations are not excluded due to the technical characteristics and color resolution of the Customer's computer. Magliette Memorabili LLP is consequently not responsible for any inadequacy of the photographic representations of the products due to the aforementioned technical reasons. In such cases, the Customer may only return the product within the terms of the withdrawal period referred to in art. 7.
Any loss of color and / or deterioration of the print are not attributable to Memorable Shirts LLP but to normal wear and tear on the garment.
In case of receipt of a product other than the one ordered, the Customer may return the product within the terms of the withdrawal period referred to in art. 7.
7.3 Product Replacement
The purchased products can be replaced, at the Customer's request, no later than 14 days from receipt of the ordered products, with others of the same model, changing size and / or color, according to the same return procedures indicated in the previous articles. 10.1. and 10.2.
The Customer can exercise the right of withdrawal also on the replaced products, following the same procedures indicated in the art. 10.
8. Compliance and Warranty
All data provided by Memorable Shirts LLP in prospectuses, catalogs, newsletters, announcements or price lists
with regard to design, colors, illustrations, measurements and weight they are purely informative.
Memorable Shirts LLP assumes no responsibility for the accuracy of such information.
9. Complaints - Communications - Information
For any information or complaint, or for any communication relating to these general conditions of sale, to orders and / or to Memorable Shirts LLP products, the Customer can contact Customer Service via the chat integrated in the site or via email at Magliettememorabili @ gmail.com

10. Provisions on privacy and protection of personal data
The collection and processing of data are carried out for the management and execution of present and future purchase orders and in particular for the execution of the obligations deriving from these General Conditions of Sale.
11. Force majeure
The execution of the services by the company Memorable Shirts LLP may be suspended in the event of the occurrence of a fortuitous event or force majeure which prevents or delays its execution. They are considered as such, events independent of the will of Diffusione Tessile, which the latter could not reasonably expect at the time of the conclusion of the sales contract such as, for example, but without limitation, war, riots, insurrections, strikes and supply problems for Memorable Shirts LLP attributable to third party suppliers. Memorable Shirts LLP will inform the Customer of the occurrence of unforeseeable circumstances or force majeure within 7 (seven) days from the occurrence of the same. In the event that the suspension of the service should be prolonged for a period exceeding 15 days, the Customer will have the possibility to cancel the order placed and will be reimbursed for the amounts already paid.
